As per YunoJuno’s latest freelancer terms, all freelancers must have insurance before accepting a booking on the platform. What is professional indemnity insurance?

Professional indemnity insurance (otherwise known as professional liability insurance) is designed to protect you against claims for negligence copyright infringement, personal injury, and more. It also provides cover for loss of documents, loss of data, breaches of intellectual property, defamation and libel.

If you do make a mistake for which you are responsible or are deemed to have been negligent, then professional indemnity insurance will cover compensation that you have to pay as a result, as well as the legal fees you incur in the process. In many ways freelancers need to take more steps to protect themselves legally. Here are some of the steps you, as a freelancer, can take to protect yourself legally.

  • Always have a contract – a well-written contract before beginning a freelance project provides both legal and financial security. A contract, when drafted correctly, is legally binding on both parties and will spell out the terms for the work. If a client refuses to pay you, a contract is your best friend when it comes to getting paid. 
  • Check your employment contract – most freelancers start out by doing freelance on the side of employment. This can be a great way to test the waters, but it could have negative legal implications.Check your employment contract for any provisions that prohibit moonlighting or non-compete clauses. 
  • Know your rights – If your work is specifically ordered by a client it might be considered “work made for hire” and the copyright ownership is transferred to the client. Be sure to read every contract thoroughly and pay attention to the terms regarding your rights to the work product created during each project.
